Legal Practice Council 2021 National Elections
The Legal Practice Council would like to inform all interested persons about the upcoming national elections for the election of a new Council in terms section 7(1)(a) of the Legal Practice Act, 2014 (Act No. 28 of 2014) (“the Act”). The term of office for the current Council members expires on 31 October 2021.
The election procedures that will be followed will be in line with Regulation 2 of the Regulations made in terms of section 109 (1)(a) of the Act (the Regulations).
In terms of Regulation 2(3)(a) only attorneys and advocates who are admitted to practise and who are enrolled may be nominated for election to the Council. Attorneys may be nominated only by attorneys and advocates may be nominated only by advocates.
The nomination process will open early in July 2021. A notice will be sent out to all legal practitioners with a link to download and complete an editable Nominations and Acceptance form. The voting period is expected to open around 3 August 2021 and will be open for 10 days.
To ensure adherence to the Regulations and to minimise person to person spread of the COVID-19 virus, the LPC has submitted a request to the Minister to amend the Regulations to allow for electronic voting and submission of serialised ballot papers via email.
Detailed notices will be sent to all practising legal practitioners closer to the time of nominations.
